The tenant had failed to pay the rental outstanding for the premises that they took from the landlord. The landlord sued for the rental outstanding, contractual interests, indemnity costs and the forfeiture of the security deposit. DLLC argued for the tenant that forfeiture of the security deposit would be deemed a penalty clause if it was not utilised for a specific purpose.
The aged weary mother was fed-up with her step-son. Staying in the same flat, the step-son did nothing and kept the place filthy. The mother and step-son rarely spoke. The mother wanted out and sought legal advice. DLLC successfully negotiated with our client’s step-son on severance of the joint-tenant and the purchase of step-son’s share in the property. We obtained a fair share for both parties and avoided further acrimony.
This is a case where the husband disposed off the matrimonial home before commencing divorce proceedings against our client. Husband did it so that he did not have to pay a share to our client. He pocketed all the sale proceeds. DLLC sued the husband in Court for her share of the sale proceeds. In the divorce suit, our client with DLLC was successful at winning care and control and even deciding which school the children could attend.
Our client was a lorry driver and he was injured while unloading some heavy items. He did not know how to make a work injury claim and how much he could receive. His original assessment under WICA was low at $38,000. We reviewed his claim and advised to pursue his claim under common law. With our advice, our client successfully received $75,000, almost 2 times his initial claim amount in about 9 months.

When buying a property, a property lawyer is able to help you vet your Option to Purchase (OTP) agreement, while you carry out your own checks on the property and the seller.
After you have chosen your property and exercised the Option, a property lawyer will lodge a caveat on the property, carry out legal checks on the title and help you liaise with the bank, and if necessary, Central Provided Fund (CPF) Board, on financing the property purchase.
After the completion of the purchase transaction, IRAS will be notified that you are the new owner of the property. This will also be taken care of by the property lawyer.
One of the first things a property lawyer will do for you is to check on your outstanding mortgage and whether there are penalties for early redemption of the mortgage. If CPF funds were used during the initial purchase of your property, they will also check the amount to be repaid including the accrued interest.
There will be a notice to the bank for redemption, which is to discharge you of the mortgage, and if any, to CPF to discharge you of the CPF charges.
The property lawyer prepares proof of all various charges that have been paid up by you, i.e. your property tax, MCST charges, and other dues.
Sometimes, you may have purchasers requesting to move in earlier for the closing transaction to be delayed or if there are any other agreements that you have made with the buyer, these details would be drafted by a property lawyer.

When should I engage a property lawyer to buy or sell a property?
A property lawyer is usually engaged once an offer is accepted by the seller. Thus, you may start looking for a suitable lawyer to carry out the sale or purchase when you are negotiating or finalising the offer. It is always good if your property lawyer could look at the Option to Purchase before you sign it.
Which banks do we work with?
Besides the CPF Board, we work with several local and foreign banks.
We put our clients’ interests first. We adopt a less restrictive approach that allows our clients to request their preferred bank to work with us. This way, you have the freedom to choose the bank with the best loan offer.
